How is child support determined in New York?
Child support payments are determined based upon statutory guidelines. The non-custodial parent (the parent who is not awarded physical custody) must pay a percentage of his or her income to the custodial parent. In some situations, the non-custodial parent may have to pay a portion of the children’s health care and education expenses.
It is possible to deviate from the guidelines. An experienced attorney can successfully advocate for a deviation from the guidelines. Child support issues often involve college and private school tuition. In these situations, the parent’s ability to pay must be established.
